The National Institutes of Health made an immediate rule change on October 5, 2026: Data Management and Sharing Plans are no longer required for NIH Career Development (K) awards under NOT-OD-26-120. NIH says the earlier implementation timeline moved from October 12, 2027, to immediate effect, and the NIH policy-change index lists that notice under October 5, 2026. For research offices, that makes this less a future compliance project than a current checklist problem.
The notice reaches every main stage of the K-award lifecycle. NIH says future K applications do not need a DMS Plan; pending K applications do not need one during pre-award steps, including Just-in-Time; and active K award recipients do not need to submit or update a plan through the Research Performance Progress Report, or RPPR NOT-OD-26-120. NIH also says it will not treat the absence of a DMS Plan as noncompliance for K awards NOT-OD-26-120. That matters because the policy-change index says NIH Guide policy notices supersede the NIH Grants Policy Statement and become terms and conditions of award.
The practical implication is straightforward even without a new form release. Internal intake scripts, routing checklists, and pre-award review that still require a K-award DMS attachment are now out of step with the October 5 notice. The same is true for Just-in-Time follow-up that asks for a missing or revised K-award DMS Plan, and for RPPR workflows that prompt active K awardees for DMS-plan updates. That reading is grounded in the older NIH DMS guidance, which describes those exact submission and monitoring points for DMS Plans Writing a Data Management and Sharing Plan. Once the later notice removes the K requirement, continuing to demand the document would reflect a stricter local process than the current NIH notice supports.
The narrow scope is just as important as the immediate effect. The DMS guidance page, last updated July 22, 2026, still says the 2026 DMS Plan format is required for all competing and non-competing awards and still places K-award plans in the PHS 398 Career Development Award Supplemental Form Writing a Data Management and Sharing Plan. But the October 5 notice says other provisions and dates in NOT-OD-26-098 remain unchanged NOT-OD-26-120. The safest reading from these records is not that NIH has stepped back from its broader DMS policy, but that K awards have been carved out from the plan requirement earlier than expected.
What the available record does not establish is the implementation status of every downstream instruction. NIH says it will update funding opportunities, instructions, award guidance, and other materials as appropriate NOT-OD-26-120. As of the October 11, 2026 source check, however, the public DMS guidance page still carried pre-change K-award language Writing a Data Management and Sharing Plan, and the policy-change index is only a listing, not an operations log. The records therefore do not show which NOFOs, Grants.gov forms, or eRA Commons prompts had been revised by that date.
That leaves research administrators with a clear rule and an incomplete rollout map. The source record is strong enough to support immediate process changes for K awards, because NIH has stated the requirement is gone and the absence of a plan is not noncompliance NOT-OD-26-120. It is not strong enough to support claims that every related system, template, and public guidance page had already caught up by October 11, 2026.
